6.0 Indemnification. You agree to defend, indemnify and hold JAMSpiritSites.com harmless from and against any and all claims, damages, costs and expenses, including attorneys' fees, arising from or related to your use of the Site.
7.0 Miscellaneous. This Agreement shall be construed in accordance with the laws of the State of Oklahoma, without regard to any conflict of law provisions. Any dispute arising under this Agreement shall be resolved exclusively by the state and federal courts of the State of Oklahoma and the parties specifically waive any legal right to bring an action in any other forum.
8.0 Uniform Domain Name Dispute Resolution Policy (As Approved by ICANN on October 24, 1999 and implemented by JAM Web Designs, Inc., on July 17th, 2004)
8.1 Purpose. This Uniform Domain Name Dispute Resolution Policy (the "Policy") has been adopted by the Internet Corporation for Assigned Names and Numbers ("ICANN"), is incorporated by reference into your Registration Agreement, and sets forth the terms and conditions in connection with a dispute between you and any party other than us (the registrar) over the registration and use of an Internet domain name registered by you. Proceedings under Paragraph 4 of this Policy will be conducted according to the Rules for Uniform Domain Name Dispute Resolution Policy (the "Rules of Procedure"), which are available at http://www.icann.org/udrp/udrp-rules-24oct99.htm, and the selected administrative-dispute-resolution service provider's supplemental rules.
8.2 Your Representations. By applying to register a domain name, or by asking us to maintain or renew a domain name registration, you hereby represent and warrant to us that (a) the statements that you made in your Registration Agreement are complete and accurate; (b) to your knowledge, the registration of the domain name will not infringe upon or otherwise violate the rights of any third party; (c) you are not registering the domain name for an unlawful purpose; and (d) you will not knowingly use the domain name in violation of any applicable laws or regulations. It is your responsibility to determine whether your domain name registration infringes or violates someone else's rights.
8.3 Cancellations, Transfers, and Changes. We will cancel, transfer or otherwise make changes to domain name registrations under the following circumstances: a. subject to the provisions of Paragraph 8, our receipt of written or appropriate electronic instructions from you or your authorized agent to take such action; b. our receipt of an order from a court or arbitral tribunal, in each case of competent jurisdiction, requiring such action; and/or c. our receipt of a decision of an Administrative Panel requiring such action in any administrative proceeding to which you were a party and which was conducted under this Policy or a later version of this Policy adopted by ICANN. (See Paragraph 4(i) and (k) below.) We may also cancel, transfer or otherwise make changes to a domain name registration in accordance with the terms of your Registration Agreement or other legal requirements.
8.4 Mandatory Administrative Proceeding. This Paragraph sets forth the type of disputes for which you are required to submit to a mandatory administrative proceeding. These proceedings will be conducted before one of the administrative-dispute-resolution service providers listed at http://www.icann.org/udrp/approved-providers.htm (each, a "Provider"). a. Applicable Disputes. You are required to submit to a mandatory administrative proceeding in the event that a third party (a "complainant") asserts to the applicable Provider, in compliance with the Rules of Procedure, that (i) your domain name is identical or confusingly similar to a trademark or service mark in which the complainant has rights; and (ii) you have no rights or legitimate interests in respect of the domain name; and (iii) your domain name has been registered and is being used in bad faith. In the administrative proceeding, the complainant must prove that each of these three elements are present. b. Evidence of Registration and Use in Bad Faith. For the purposes of Paragraph 4(a)(iii), the following circumstances, in particular but without limitation, if found by the Panel to be present, shall be evidence of the registration and use of a domain name in bad faith: (i) circumstances indicating that you have registered or you have acquired the domain name primarily for the purpose of selling, renting, or otherwise transferring the domain name registration to the complainant who is the owner of the trademark or service mark or to a competitor of that complainant, for valuable consideration in excess of your documented out-of-pocket costs directly related to the domain name; or (ii) you have registered the domain name in order to prevent the owner of the trademark or service mark from reflecting the mark in a corresponding domain name, provided that you have engaged in a pattern of such conduct; or (iii) you have registered the domain name primarily for the purpose of disrupting the business of a competitor; or (iv) by using the domain name, you have intentionally attempted to attract, for commercial gain, Internet users to your web site or other on-line location, by creating a likelihood of confusion with the complainant's mark as to the source, sponsorship, affiliation, or endorsement of your web site or location or of a product or service on your web site or location. c. How to Demonstrate Your Rights to and Legitimate Interests in the Domain Name in Responding to a Complaint. When you receive a complaint, you should refer to Paragraph 5 of the Rules of Procedure in determining how your response should be prepared. Any of the following circumstances, in particular but without limitation, if found by the Panel to be proved based on its evaluation of all evidence presented, shall demonstrate your rights or legitimate interests to the domain name for purposes of Paragraph 4(a)(ii): (i) before any notice to you of the dispute, your use of, or demonstrable preparations to use, the domain name or a name corresponding to the domain name in connection with a bona fide offering of goods or services; or (ii) you (as an individual, business, or other organization) have been commonly known by the domain name, even if you have acquired no trademark or service mark rights; or (iii) you are making a legitimate noncommercial or fair use of the domain name, without intent for commercial gain to misleadingly divert consumers or to tarnish the trademark or service mark at issue. d. Selection of Provider. The complainant shall select the Provider from among those approved by ICANN by submitting the complaint to that Provider. The selected Provider will administer the proceeding, except in cases of consolidation as described in Paragraph 4(f). e. Initiation of Proceeding and Process and Appointment of Administrative Panel. The Rules of Procedure state the process for initiating and conducting a proceeding and for appointing the panel that will decide the dispute (the "Administrative Panel"). f. Consolidation. In the event of multiple disputes between you and a complainant, either you or the complainant may petition to consolidate the disputes before a single Administrative Panel. This petition shall be made to the first Administrative Panel appointed to hear a pending dispute between the parties. This Administrative Panel may consolidate before it any or all such disputes in its sole discretion, provided that the disputes being consolidated are governed by this Policy or a later version of this Policy adopted by ICANN. g. Fees. All fees charged by a Provider in connection with any dispute before an Administrative Panel pursuant to this Policy shall be paid by the complainant, except in cases where you elect to expand the Administrative Panel from one to three panelists as provided in Paragraph 5(b)(iv) of the Rules of Procedure, in which case all fees will be split evenly by you and the complainant. h. Our Involvement in Administrative Proceedings. We do not, and will not, participate in the administration or conduct of any proceeding before an Administrative Panel. In addition, we will not be liable as a result of any decisions rendered by the Administrative Panel. i. Remedies. The remedies available to a complainant pursuant to any proceeding before an Administrative Panel shall be limited to requiring the cancellation of your domain name or the transfer of your domain name registration to the complainant. j. Notification and Publication. The Provider shall notify us of any decision made by an Administrative Panel with respect to a domain name you have registered with us. All decisions under this Policy will be published in full over the Internet, except when an Administrative Panel determines in an exceptional case to redact portions of its decision. k. Availability of Court Proceedings. The mandatory administrative proceeding requirements set forth in Paragraph 4 shall not prevent either you or the complainant from submitting the dispute to a court of competent jurisdiction for independent resolution before such mandatory administrative proceeding is commenced or after such proceeding is concluded. If an Administrative Panel decides that your domain name registration should be canceled or transferred, we will wait ten (10) business days (as observed in the location of our principal office) after we are informed by the applicable Provider of the Administrative Panel's decision before implementing that decision. We will then implement the decision unless we have received from you during that ten (10) business day period official documentation (such as a copy of a complaint, file-stamped by the clerk of the court) that you have commenced a lawsuit against the complainant in a jurisdiction to which the complainant has submitted under Paragraph 3(b)(xiii) of the Rules of Procedure. (In general, that jurisdiction is either the location of our principal office or of your address as shown in our Whois database. See Paragraphs 1 and 3(b)(xiii) of the Rules of Procedure for details.) If we receive such documentation within the ten (10) business day period, we will not implement the Administrative Panel's decision, and we will take no further action, until we receive (i) evidence satisfactory to us of a resolution between the parties; (ii) evidence satisfactory to us that your lawsuit has been dismissed or withdrawn; or (iii) a copy of an order from such court dismissing your lawsuit or ordering that you do not have the right to continue to use your domain name.
8.5 All Other Disputes and Litigation. All other disputes between you and any party other than us regarding your domain name registration that are not brought pursuant to the mandatory administrative proceeding provisions of Paragraph 4 shall be resolved between you and such other party through any court, arbitration or other proceeding that may be available.
8.6 Our Involvement in Disputes. We will not participate in any way in any dispute between you and any party other than us regarding the registration and use of your domain name. You shall not name us as a party or otherwise include us in any such proceeding. In the event that we are named as a party in any such proceeding, we reserve the right to raise any and all defenses deemed appropriate, and to take any other action necessary to defend ourselves.
8.7 Maintaining the Status Quo. We will not cancel, transfer, activate, deactivate, or otherwise change the status of any domain name registration under this Policy except as provided in Paragraph 3 above.
8.8 Transfers During a Dispute. a. Transfers of a Domain Name to a New Holder. You may not transfer your domain name registration to another holder (i) during a pending administrative proceeding brought pursuant to Paragraph 4 or for a period of fifteen (15) business days (as observed in the location of our principal place of business) after such proceeding is concluded; or (ii) during a pending court proceeding or arbitration commenced regarding your domain name unless the party to whom the domain name registration is being transferred agrees, in writing, to be bound by the decision of the court or arbitrator. We reserve the right to cancel any transfer of a domain name registration to another holder that is made in violation of this subparagraph. b. Changing Registrars. You may not transfer your domain name registration to another registrar during a pending administrative proceeding brought pursuant to Paragraph 4 or for a period of fifteen (15) business days (as observed in the location of our principal place of business) after such proceeding is concluded. You may transfer administration of your domain name registration to another registrar during a pending court action or arbitration, provided that the domain name you have registered with us shall continue to be subject to the proceedings commenced against you in accordance with the terms of this Policy. In the event that you transfer a domain name registration to us during the pendency of a court action or arbitration, such dispute shall remain subject to the domain name dispute policy of the registrar from which the domain name registration was transferred.
8.9 Policy Modifications. We reserve the right to modify this Policy at any time with the permission of ICANN. We will post our revised Policy at www.JAMSpiritSites.com at least thirty (30) calendar days before it becomes effective. Unless this Policy has already been invoked by the submission of a complaint to a Provider, in which event the version of the Policy in effect at the time it was invoked will apply to you until the dispute is over, all such changes will be binding upon you with respect to any domain name registration dispute, whether the dispute arose before, on or after the effective date of our change. In the event that you object to a change in this Policy, your sole remedy is to cancel your domain name registration with us, provided that you will not be entitled to a refund of any fees you paid to us. The revised Policy will apply to you until you cancel your domain name registration.
9.0 Termination. This Agreement is effective unless and until terminated by either you or JAMSpiritSites.com. You may terminate this Agreement at any time. JAMSpiritSites.com also may terminate this Agreement at any time and may do so immediately without notice, and accordingly deny you access to the Site, if in JAMSpiritSites.com's sole discretion you fail to comply with any term or provision of this Agreement. Upon any termination of this Agreement by either you or JAMSpiritSites.com, you must promptly destroy all materials downloaded or otherwise obtained from this Site, as well as all copies of such materials, whether made under the terms of this Agreement or otherwise.
10.0 SpiritSite Terms of Service. This Agreement sets forth JAMSpiritSites.com's terms of service. All services provided by JAMSpiritSites.com are provided in accordance with this document. JAMSpiritSites.com may modify this document from time to time as needed by publishing it online.
10.1 SERVICE. JAMSpiritSites.com, as an Internet World Wide Web service provider, provides a server computer that is integrated into the Internet. This server computer sends and receives information as related to the World Wide Web. Customer desires to connect to and utilize the software and hardware facilities of JAM within the SpiritSite network. The use of any data or material by the Customer via the service provided by JAMSpiritSites.com is at the Customer's sole and absolute risk. JAMSPIRITSITES.COM SPECIFICALLY DISCLAIMS AND DENIES ANY RESPONSIBILITY FOR THE COMPLETENESS AND/OR ACCURACY OF QUALITY OF ANY AND ALL INFORMATION OBTAINED THROUGH THE SERVICES TO BE PROVIDED HEREBY.
10.2 USE OF SERVICE. This agreement hereby is intended for the use of only one web site unless otherwise stated in service plan. It is for the exclusive use of the Customer whose name specifically appears on the order and/or contract and does not extend to any other person or entity. Customer may assign SpiritSite privileges, if desired, to third parties with the knowledge of and written permission by JAMSpiritSites.com, which shall not be unreasonably withheld. Client is responsible for the content of any website assigned to a third party and the third party shall be bound by the terms under this agreement. The domain name, along with all template(s), graphics, multimedia content and components (collectively, the "SpiritSite"), available from the entry point of the domain (the "Site") and all related code within Customer's site are the property of JAMSpiritSites.com and/or its affiliates. All material provided by Customer, including copyrighted, trademarked, or word marked images, text, audio clips and video clips is the sole property of the Customer or any third party assigned by Customer. JAMSpiritSites.com is not and will not be held responsible for the loss or damage of any customer materials and/or data.
10.3 DISCLAIMER
JAMSpiritSites.com, at its sole discretion, may change the terms, conditions and operation of this website (the "Site") at anytime. By using this service the user agrees to the terms of this disclaimer and further waives any rights or claims it may have against JAMSpiritSites.com. From time to time there may be information on JAMSpiritSites.com that contains typographical errors, inaccuracies, or omissions. We reserve the right to correct any errors, inaccuracies or omissions and to change or update information at any time without prior notice.

10.4 INDEMNIFICATION. Customer agrees that it shall defend, Indemnify, save and hold harmless from any and all demands, liabilities, losses, costs, claims, including reasonable attorney's fees ("Liabilities") against JAMSpiritSites.com, its agents, its customers, servants, officers, employees, that may arise or result from any services provided, performed or agreed to be performed or any product sold by Customer, its agents, employees or assigns, within their SpiritSite. Customer agrees to defend, indemnify and hold harmless JAMSpiritSites.com against Liabilities arising out of any injury to person or property caused by any products sold or distributed in connection with JAMSpiritSites.com's server or services, material supplied by Customer infringing or allegedly infringing on the proprietary rights of a third party, copyright infringement and any defective product which Customer sold on JAMSpiritSites.com's servers. As a result of this, Customer agrees that JAMSpiritSites.com shall not be liable to Customer for any claims of actual, compensatory and/or consequential damages which may be suffered by Customer, including, but not limited to, losses or damages due to the loss data resulting from delays, non deliveries, or service interruptions caused by the fault or negligence of JAMSpiritSites.com. Notwithstanding the above mentioned, Customer's exclusive remedies, damages, losses and causes of actions shall not exceed the aggregate dollar amount which Customer paid and retained by JAMSpiritSites.com during the quarter in which the dispute occurred.
10.5 SPIRITSITE NETWORK ACCESS FEE. Billing for a SpiritSite shall be as follows: Customer shall be billed in accordance with the above stated terms, unless otherwise agreed upon in writing and executed by both parties. Payments of the service fee will be due upon inception (sign-up date). Monthly network access fees will be In the event that Customer shall fail to pay in advance for the services provided herein or in the event there shall exist any delinquency in the Customer's account then, in such event, JAMSpiritSites.com reserves the right, in its sole, absolute and unfettered discretion, to terminate this agreement and discontinue service to the Customer without notice or liability for actual, compensatory or consequential damages to Customer for the interruption in service. JAMSpiritSites.com shall be entitled to unilaterally terminate this agreement, in which case the provisions of paragraph 1, 2, 3, 4 and 5 shall continue in full force and effect, and/or, at its sole discretion, JAMSpiritSites.com may discontinue or suspend service to Customer until payment is made. Any service disconnection or suspension will result in the requirement of re-connect fee.
10.6 30 DAY-MONEY BACK GUARANTEE. JAMSpiritSites.com's 30 day money back guarantee will only apply to hosting services (Business Site, Business Site Plus and Virtual Server). The 30 day money-back shall apply to the refund on the agreed upon monthly plan fees and shall exclude, without limitation, the refund of any or all setup fees, service fees, transfer fees, domain registration fees, design/development fees, software purchase fees, and any promotional discounts, etc. ONLY web hosting monthly fees are refundable. Customer will automatically be charged non-refundable additional fees in the event that this Customer is in excessive use of the agreed upon services, including, but not limited to, the use of additional bandwidth, file transfers in excess of plan limits, or mega byte space.
10.7 CANCELLATION AND EARLY TERMINATION. The "term" of this SpiritSite agreement will be from one month from the sign-up date unless explicitly expressed in writing and agreed upon both by Customer and an authorized SpiritSites.com representative. All cancellations in accordance with the terms and conditions contained herein must be submitted in writing via facsimile transmittal or Customer may submit a request for cancellation in writing via registered mail. A 30 Day Notice is required for all cancellation requests. All Customer accounts must be paid in full before the transaction will be considered complete. Any contracts terminated prior to the end of said term will be subject to an early cancellation fee equal to fifty (50%) percent of the remaining service fees unless otherwise stated in a service contract between Customer and JAMSpiritSites.com.
10.8 TAXES. Customer shall be responsible for paying all taxes of any nature except for taxes on JAMSpiritSites.com's income, irrespective of which party may be responsible for reporting or collecting such taxes.
10.9 MODIFICATIONS. JAMSpiritSites.com reserves the right to make changes to any of the above terms and conditions of this agreement immediately and without notice to Customer. Changes in monthly service fees are effective only at the end of any calendar quarter for which Customer has already prepaid. The use of the service by the Customer following the effective date of such change shall be proof of acceptance of Customer of such change(s).
11.0 ENTIRE AGREEMENT AND SEVERABILITY. Unless otherwise provided in a companion document or contract, this instrument constitutes the entire agreement between the parties, and represents the complete and entire understanding of the parties with respect to the subject matter contained in this agreement. In the event that any term or provision of this instrument is held by a court of competent jurisdiction to be unenforceable, then the remaining provisions of this instrument and the agreement which it evidences shall remain in full force and effect. IN WITNESS WHEREOF the parties intending to be legally bound hereby, and in consideration of the covenants and agreements contained herein, do hereby execute this instrument with each party warranting their ability to enter into this agreement for the person or entity pursuant to the law of the State of Oklahoma. This Agreement will be held in accordance with the laws of the State of Oklahoma. Any actions brought against JAMSpiritSites.com must be done in the County of Oklahoma in Oklahoma and the parties specifically waive any legal right to bring an action in any other forum.
12.0 RESTRICTIVE USE. The Customer may only use JAMSpiritSites.com's service for lawful purpose. In the event that at any given time, JAMSpiritSites.com believes that the service is being used by the Customer in contravention with any of the terms and provisions contained in this agreement, JAMSpiritSites.com has the right to immediately discontinue such service to Customer without liability whatsoever. The following are restrictive uses and shall be cause for the immediate termination of web services and this agreement without notice and without refund to the Customer. JAMSpiritSites.com will act as the sole judge as to what constitutes a violation.
13.0 ACCEPTABLE ACCOUNT USAGE. To better serve our customers and offer a more reliable service, JAMSpiritSites.com has developed this acceptable use policy to define the types of behavior that will not be permitted on SpiritSite network. The SpiritSite network, including the websites hosted by JAMSpiritSites.com (collectively, the 'SpiritSite network'), may be used only for lawful purposes. Users may not use the SpiritSites network in order to transmit, distribute or store material (a) in violation of any applicable law, (b) in a manner that will infringe the copyright, trademark, trade secret or other intellectual property rights of others or the privacy, publicity or other personal rights of others, or (c) that is obscene, threatening, abusive or hateful, including the advocating of terrorism and/or the killing of any individual or group, and (d) as more specifically described herein.
14.0 RESPONSIBLE USAGE. The Customer must take responsibility for their actions on the SpiritSites network, and any systems accessed through said network. This includes, but is not limited to, statements made through electronic mail, chat and discussion forums, and Usenet news groups. If the Customer, or Customer's assignee is found to have exercised irresponsible behavior, whether intentional or unintentional, endangering the SpiritSites network or another network's systems, company or individual, JAMSpiritSites.com may suspend Customer's access at any time, without prior notice. JAMSpiritSites.com management shall be the final and sole judge of whether abuse or violations have occurred.
14.1 System and Network Security. Users are prohibited from violating or attempting to violate the security of the SpiritSites network, including, without limitation, (a) accessing data not intended for such User or logging into a server or account which such User is not authorized to access, (b) attempting to probe, scan or test the vulnerability of a system or network or to breach security or authentication measures without proper authorization, (c) attempting to interfere with service to any user, host or network, including, without limitation, via means of overloading, 'flooding', 'mailbombing' or 'crashing', (d) forging any TCP/IP packet header or any part of the header information in any e-mail or newsgroup posting, or (e) taking any action in order to obtain services to which such User is not entitled. Violations of system or network security may result in civil or criminal liability. JAMSpiritSites.com will investigate occurrences which may involve such violations and may involve, and cooperate with, law enforcement authorities in prosecuting Users who are involved in such violations.
14.2 Mass Electronic Mail. This section outlines JAMSpiritSites.com's policy on unsolicited mass e-mail and newsgroup postings, commonly known as, and referred to herein as "SPAM". For the purpose of this document, "unsolicited e-mail" shall be defined as: any electronic mail sent to a given list of address(es) for which the owner(s) have not given permission, express or otherwise, for the Customer's use in mass communication. SpiritSites network resources may not be used by Customer to e-mail or mass e-mail any user, or groups of users who have not indicated a willingness to receive said mailings. Any violation of this policy may result in termination of this agreement and service disconnection without prior notice to Customer. JAMSpiritSites.com management will act as final and sole judge in determining if a violation has occurred.
14.3 Relaying of Electronic Mail. JAMSpiritSites.com does not allow our systems to be used for RELAY from non-SpiritSite customers or networks.
14.4 Censorship. JAMSpiritSites.com has a policy of no-censorship, either from or to our systems, UNLESS, the information transmitted is illegal in nature, or clearly used to commit fraudulent activity. Additionally, the SpiritSites network may not be used to host Adult-oriented websites or materials, including those depicting nudity or acts of a sexual nature. At the sole discretion of JAMSpiritSites.com management, any violation of the above will result in service disconnection and termination of this agreement without notice or liability to actual, compensatory or consequential damages to Customer.
14.5 Child Pornography. JAMSpiritSites.com will cooperate fully with any criminal investigation into a Customer's violation of the Child Protection Act of 1984 concerning child pornography. Customers are ultimately responsible for the actions of their clients over the SpiritSite network, and will be liable for illegal material posted by their clients. According to the Child Protection Act, child pornography includes photographs, films, video or any other type of visual presentation that shows a person who is or is depicted as being under the age of eighteen years and is engaged in or is depicted as engaged in explicit sexual activity, or the dominant characteristic of which is the depiction, for a sexual purpose, of a sexual organ or the anal region of a person under the age of eighteen years any written material or visual representation that advocates or counsels sexual activity with a person under the age of eighteen years. No credits will be issued for any interruption in service resulting from policy violations. Violations of the Child Protection Act may be reported to the U.S. Customs Agency at icpicc@customs.treas.gov.
14.6 Shared Resource Usage. Customer hereby acknowledges that JAMSpiritSites.com may, from time to time, establish general practices and limits concerning the use of the SpiritSite Network, including without limitation (a) the maximum limits on bandwidth usage and (b) maximum limits on storage space for each SpiritSite package. Any foregoing limits will be consistent with the package (including upgrades) for which Customer has registered. JAMSpiritSites.com, in its sole discretion, will not allow Customer to consume excessive system resources on the SpiritSite network. Customer agrees that any excessive use of system resources will be billed at a predetermined rate specified by JAMSpiritSites.com in the service agreement. Customer further acknowledges that JAMSpiritSites.com reserves the right to change the general practices and limits at any time, in its sole discretion, with or without prior notice.
14.7 Security. JAMSpiritSites.com actively and automatically monitors all of our systems for attempts at breaching our security, or attempts to access systems or resources that are not available for customers to use or access. This is commonly known as "hacking." Any attempt to access or modify unauthorized computer system information or to interfere with normal system operations, whether on the equipment of JAMSpiritSites.com or of any other computer system or network that is accessed by our services, will result in immediate and permanent cancellation of your account(s) and may lead to other legal proceedings against you. ANYONE FOUND ACCESSING OR ATTEMPTING TO ACCESS UNAUTHORIZED JAMSPIRITSITES.COM OR SPIRITSITE CUSTOMER EQUIPMENT WILL HAVE THEIR ACCOUNT IMMEDIATELY TERMINATED AND THE INCIDENT REPORTED TO THE OKLAHOMA CITY BUREAU OF THE FBI and respective Attorney General's office. JAMSpiritSites.com fully cooperates with authorities during such an investigation.
14.8 Unlawful Usage. JAMSpiritSites.com’s network of information services may only be used for lawful purposes. Transmission of any material in violation of any federal, state or local regulation is prohibited. This includes copyrighted material, including but not limited to, MP3 audio files, photographs and other media not licensed to the individual. Additionally, material judged to be threatening, obscene, or material protected by trade secret is prohibited.
14.9 Privacy. While every attempt is made to keep all information passing to and from our systems, and to and from our customers, private, you must assume that any information that you transmit or receive may not be private. JAMSpiritSites.com does not monitor or record normal usage of our systems. However, JAMSpiritSites.com will fully cooperate with any authority in the investigation of illegal activity and may turn over logs and records upon receipt of proper orders. JAMSpiritSites.com fully reserves the rights to conduct an audit if JAMSpiritSites.com believes there has been a violation of this Agreement or the Law. Any User interacting with our site and providing JAMSpiritSites.com with name, address, telephone number, e-mail address, domain name or URL or any other personally identifiable information permits JAMSpiritSites.com to use such information for commercial purposes of its own, including contacting Users about products and services which may be of interest. For each visitor to our Web Site, our Web server recognizes only the visitor's domain name, not the e-mail address. We collect information volunteered by the visitor, such as form submittals and/or site registrations. This information is used to improve the content of our Web site, it is not shared with other organizations for commercial purposes. JAMSpiritSites.com provides a safe, fun, personalized, and informative online community for connecting players, coaches and families to the sports they love. To uphold this community, JAMSpiritSites.com is committed to safeguarding our users' privacy, especially the privacy of our child users. (For the purposes of this policy a child is a person 12 years of age or younger).
While JAMSpiritSites.com uses its own measures to protect the privacy of its child users (U13 user accounts must receive parental permission), we are also compliant with the Children's Online Privacy Protection Act, otherwise known as COPPA.
